By and through this APPLICATION made by the undersigned, hereinafter known as the water service user (WSU) with his FREE and voluntary act and deed and duly approved by the General Manager, this undersigned APPLICANT agrees to the following TERMS and CONDITIONS relative to his USAGE and enjoyment of the WATER SERVICES provided by ROXAS WATER DISTRICT (RWD).

1. This application will have force and effect as soon as it is signed by both the user (WSU) and the provider of the water services (RWD).
2. The WSU shall pay the service connection fee including the notarial fee and other fees the RWD may so require.
3. The WSU shall USE and enjoy ON A MONTHLY BASIS, the District’s water services.
4. The usage and enjoyment of the District’s water service is automatically renewed in favor of the WSU, unless otherwise, upon due notice and within a reasonable period of time, TERMINATED by either the WSU or by the District.
5. The WSU shall pay his monthly Water Consumption at the RWD office within FIFTEEN (15) Days from the date of bill delivery, without the necessity of demand from the RWD. A 10% penalty on the account shall be charged for failure of paying the bill within THREE (3) days after due date.
6. The RWD reserves the right to, without further NOTICE, CUT-OFF or STOP the water service connection of the WSU without prejudice to the collection of reconnection fees when the WSU fails to fully pay any TWO (2) months water consumption billed by RWD.
7. The WSU shall notify the RWD within two (2) days should the WSU permanently vacate or leave the building or property he owns or leases, where that water service is connected.
8. The WSU shall not make any form of tapings or sub connection on his pipe without the written permission of the RWD. Likewise, any form of water peddling or sale of water from the service pipe and/or faucet is DISALLOWED.
9. The WSU shall provide the water meter that shall be installed in his water service connection in case the RWD fails to provide one; likewise, the WSU shall be made liable to any loss, damage or tampering of the water meter supplied to him by the RWD.
10. After full payment of the necessary and approved installation charges and rates by the WSU, EXCAVATION and INSTALLATION shall be done exclusively by the RWD.
11. The District may summarily STOP and/or DISCONNECT the water service connection provided to the applicant/user for breach and violation of any of the TERMS and CONDITIONS stipulated herein.
12. The WSU shall allow the RWD, through its authorized representative, to enter his/her premises to perform their official function without being accused later of unlawful entry on the WSU’s land and property.
13. The District shall not be made liable for any water service interruptions due to FORTUITOUS EVENTS or causes beyond its control.
14. For any court litigation that may arise from this agreement due to WSU’s breach and/or violation of the terms and conditions stipulated herein, the RWD shall be entitled to collect from the WSU the following accrued bills, damage, cost of litigation including attorney’s fee to such amount as may be determined by the COURT.
15. These agreement rules and regulation on the WATER SERVICE applied for and other RWD policies consistent with the above water services being provided to the WSU are affirmed and adopted with the following additional terms and conditions.
